Welcome to Graham Hall

Your Homeowners’ Association thanks you for choosing to become a part of our Community. Graham Hall Homeowners’ Association Board welcomes you to our community and asks you to read this information pertaining to the restrictions and procedures that apply to Graham Hall Homeowners’ Association. If you have any questions, please contact one of our Board Members for assistance. Please note... approval is required prior to any construction or renovation on any Graham Hall property. Thank you for your cooperation in making our community a nice place to live for us all. We want to make your transition into your new home as convenient as possible. We hope you will like your new surroundings and get acquainted with your neighbors. The purpose of this information is to let you know about the Homeowners’ Association and your community. Please refer to the official By-laws. They describe more fully, the restrictions on each Graham Hall property and the responsibilities of belonging to the Graham Hall Homeowners’ Association.

Your Homeowners’ Association

The Homeowners’ Association was formed to administer and enforce the restrictions, conditions, covenants and reservations to which all Graham Hall properties are subject.

Information pertaining to the make-up, definitions and policies of the Graham Hall Homeowners’ Association is detailed in the Graham Hall Homeowners’ Association By-Laws. Information pertaining to the restrictions, conditions, covenants and reservations to which all properties are subject is detailed in the Declaration of Covenants, Conditions, and Restrictions for Graham Hall. These documents were provided to all Owners upon purchase of a Graham Hall property. This Document provides a summary of the restrictions, services and the rules and regulations that have been promulgated by the Association Each Owner is responsible for compliance with all governing documents. If you have not received a copy, please contact a board member.

Summary of Restrictions and Services

Children
Homeowners are responsible for the conduct of their children. Parents are responsible for watching their children.

Please do not leave bicycles, toys, etc., on any part of community property. Unattended items can be a potential hazard to others’ safety, are unattractive, and an inconvenience to neighbors.

Disturbances
In the best interest of good neighbor relations, please be conscious of the noise level inside and outside of your home. Anyone who has problems with noise from neighbors or their guests should call the sheriff’s department, as this is not an Association issue.

Pets
No animals or poultry of any kind shall be kept on any Lot, except those commonly recognized as domestic house pets. Domestic pets shall be on a leash or confined to the Owner’s lot and shall not be permitted to defecate or run free on the property of others or common areas of Graham hall. Dog houses must not be visible from the street.

Parking/Vehicles
All vehicles shall be parked in your garage or driveway. Also, please be courteous and do not block your neighbor’s driveway at any time.

Trash
Homeowners are responsible for securing trash removal service or bringing your trash to the landfill yourself. All trash stored outside of the house must be stored in a proper container with a lid. No trash cans, garbage containers, recycling containers or related enclosures shall be located in the front or side lawn area of any lot for more than a 24-hour period. Trash placed at the curb must be stored inside a proper container with a lid. Empty containers must be returned to their stored location within 24 hours of placing them at the curb. No large articles, tires, etc., are to be stored outside of your home at any time.

Fences
Fences are allowed but must be made of wood and cannot exceed 6’ in height. Any type of outbuilding, storage shed, etc. must be approved by the Board of Directors prior to construction and must comply with County codes as well.

Lawn Mowing
Lawns need to be mowed weekly and kept neat and trimmed. If we all use care and consideration for our community our dues will continue to be manageable. During the summer months a community clean up is done the 3rd Saturday of each month to keep our common areas clean.

Misc. Info
Ladders, machinery and other eye sore objects are not permitted in the front of your property.

Clothes cannot be hung to dry in bushes or anywhere in the front of your property.

 

Rules & Summary of
Association Regulations

Homeowners’ Association Fee
Owners may choose to pay a full year’s dues on or before June 1st of every year. You may make partial payments up and until June 1st but all money is due in full by June 1st of every year.

Checks are to be made payable to Graham Hall Homeowners’ Association. (There will be a $25.00 returned check charge.)

HOA Late fees
Accounts not current by June 1st will be granted a 30 day grace period and then will be charged a twenty-percent (20%) late fee. The board can and will file a Summons and Complaint with the Jasper County Magistrate Office when fees owed to the HOA are delinquent and that may result in a lien placed on the property. Also, the homeowner will be responsible for the filing fee as required by Jasper County Magistrate Office.

Homeowners’ Association Board
The Homeowner’s Association Board ensures that the covenants, conditions and restrictions are observed and that our Community continues to project an attractive and desirable environment for all Owners.

Violations and Remedies
The Declaration of Covenants, Conditions and Restrictions and the Association’s Rules and Regulations will be enforced by the Association to the fullest extent permitted by law.

It is the responsibility of the homeowner (whether residing in the home, or acting as the landlord) to fully comply with the Declaration of Covenants, Conditions & Restrictions for Graham Hall, to prevent any condition of structures on a lot that would be unsuitable or undesirable in its opinion, for aesthetic or other reasons or that does (or would) decrease the attractiveness or value of any property in the Graham Hall Development.

Whenever a violation or breach of the Declaration or the Association Rules and Regulations is brought to the attention of an owner by the Board, or its designee by virtue of a Notice of Violation letter, the owner then has a period of thirty (30) days to remedy the breach (unless a longer period is granted) or request a hearing before the Board.

If, after thirty days from the date of the Notice of Violation letter, the violation has not been remedied and no Request for Extension or Hearing has been received by the Board, the Board will levy fines against the owner for the violation or breach.

Request for Extension and Request for Hearing Forms may be obtained by contacting a member of the Board.

Fines will be imposed as follows:
1) $50.00 will be imposed thirty (30) days from the date of the Notice of Violation letter,
provided that owner has not remedied the violation, received an extension or scheduled a hearing;

2) $100.00 ten (10) days after the first fine was imposed;

3) $300.00 ten (10) days after the second fine was imposed.
After the third fine has been imposed, the Board or its designee can and will take the necessary legal action to remedy the violation or breach and collect the fines. If it becomes necessary for the Association or its designee to take legal action, all expenses of the Association in connection with any such actions or proceedings, including court costs and attorney’s fees and any other fees and expenses and all damages, shall be charged to and assessed against such defaulting Owner.

IMPORTANT: If extenuating circumstances prevent the Owner from remedying the violation or breach within thirty (30) days from the Notice of Violation, the Owner must submit a written request to the Board for an extension. The request should include the reason that the extension is necessary, the amount of time requested and a date by which the violation will be remedied. The request must be received by the Board prior to the expiration of the original thirty (30) day allotment. The extension may or may not be granted at the discretion of the HOA. In either case, the Owner will promptly be notified in writing of the determination.

Board Meetings
Your Board members meet on the 1st Wednesday of every month. Email notices will be sent with date, time and location. Agenda's will be available at the meeting. A sign will also be set out as a reminder. Owners are invited and encouraged to come to the meetings and participate.
